Proposition 8 passes every day, until it’s repealed.

That’s right. When you woke up this morning, Prop 8 passed, and tomorrow morning it will pass again. Until Prop 8 is repealed by a new ballot initiative, each day will be a day in which the precious right to marry is stolen from millions of Californians – just as though Prop 8 were voted on again.

To honor the 40th anniversary celebration, in June 2009, of the Stonewall Riots, OutHistory.org is, for the first time, publishing nine pages of New York City Police Department records created early on the morning of the rebellion’s start, June 28, 1969.


Reproduced in facsimile with transcriptions, these sometimes hard-to-read but historic documents provide an immediate sense of what the police called an "Unusual Occurrence" at the Stonewall -- the rebellion that has come to symbolize the start of the modern, militant LGBTQ movement for civil rights and liberation.

"God, Sex, and Justice" is the title of this sermon. God and justice—we certainly know they belong together. But God and sex— and in church? It may be a puzzle to some because we have been the lifelong recipients of double messages. "Sex is good and beautiful, but let's not talk about it in church." Or, "Sex is dirty. Save it for someone you love!" I never have understood how that works!

Years ago the psychologist Carl Jung observed that religion and sexuality were closely intertwined. When people brought to him religious questions, they turned out to be sexual issues. And when they came with sexual questions, they turned out to be religious ones.

On June 26, 2008, 1,000 ministers, mostly from evangelical congregations, met by conference call to discuss tactics for passing Proposition 8, a ballot initiative to ban same sex marriage in California by amending the state constitution. The call was convened by Pastor Jim Garlow from the 2,500-member Skyline Church in San Diego County. The ministers on the call had a far reach: they lead congregations representing about one million people, and Garlow alone provides radio commentary to 629 stations each day.

            I want to talk about “civil rights” because I believe “gay rights” are “civil rights.”

            As my late neighbor and friend, Coretta Scott King, said in 1998:

            “Homophobia is like racism and anti-Semitism and other forms of bigotry in that it seeks to dehumanize a large group of people, to deny their humanity, their dignity and personhood. “

 

And in 2000 she added:

 

            “We have a lot more work to do in our common struggle against bigotry and discrimination.  I say ‘common struggle’ because I believe very strongly that all forms of bigotry and discrimination are equally wrong and should be opposed by right-thinking Americans everywhere. Freedom from discrimination based on sexual orientation is surely a fundamental human right in any great democracy, as much as freedom from racial, religious, gender or ethnic discrimination.”

 

That is why, in 2006, the NAACP unanimously passed a

resolution stating:

            “[W]e shall pursue all legal and constitutional means to support non-discriminatory policies and practices against persons based on race, gender, sexual orientation, nationality or cultural background.”

The California Supreme Court finds itself center stage this Thursday when it will hear oral arguments on whether it should uphold Proposition 8's ban on same-sex marriage.

The case touches the heart of our democracy and poses a profound question: can a bare majority of voters strip away an inalienable right through the initiative process? If so, what possible meaning does the word inalienable have?
